Terms of Service

Note: These terms are a customer-friendly draft for product transparency and should be reviewed by qualified legal counsel before final legal use.
1. Acceptance of Terms
These Terms are between you and Gustav Intelligence, Inc. ("RealtorDock", "we", "us"). They govern your use of RealtorDock websites, applications, APIs, and related services (the "Services").
By using the Services, you agree to these Terms and our Privacy Policy.
If you use the Services for an organization, you confirm you are authorized to accept these Terms on that organization's behalf.
2. Eligibility and Accounts
You must provide accurate account information and keep credentials secure.
You are responsible for activity on your account and for users you invite under your workspace.
You must comply with applicable real estate, privacy, and communications laws in your jurisdiction.
3. Plans, Architecture Tiers, and Billing
RealtorDock offers tiered plans that map to AI architecture options, including logical sandbox, ephemeral sandbox, and dedicated-instance offerings.
Plan availability, pricing, and included limits are shown on the pricing page and may be updated with notice.
Paid plans renew automatically unless cancelled. You authorize recurring charges for your subscription and any approved top-ups.
4. Standard and Premium Actions
AI usage is measured through platform-defined Action categories (for example, Standard Actions and Premium Actions).
Each plan includes a set monthly allowance. Additional usage can be purchased through top-up packs where available.
Hard caps may pause usage when limits are reached. Admin settings control whether additional usage can be approved.
5. AI Processing and Third-Party Providers
To provide AI features, RealtorDock may process data using third-party model providers, including OpenAI, Anthropic, and Google.
Provider selection may vary by task and can change over time for quality, reliability, or safety reasons.
We apply data-minimization and access controls designed to send only what is needed for the requested feature.
6. User Approval and Communication Responsibility
You control workflow settings for outbound communication and approvals.
If you enable automated sends, you are responsible for lawful use and message content.
You are responsible for reviewing AI-generated communications and ensuring compliance before delivery.
7. Acceptable Use
You may not misuse the Services, violate law, infringe rights, or attempt unauthorized access.
You may not use the Services to send unlawful spam, impersonate others, or generate deceptive content.
We may suspend or terminate access for violations or security risks.
8. Data Handling and Security Controls
RealtorDock uses security controls such as encryption in transit, role-based access, tenant isolation measures, and audit logging for key administrative and operational events.
No system is perfectly secure, and you acknowledge residual risk inherent in cloud services.
9. Intellectual Property
RealtorDock retains ownership of the Services and platform content.
You retain ownership of content you submit, and grant RealtorDock a limited license to host and process that content to operate the Services.
AI outputs may require review and editing before business use, and output rights may vary by law.
10. Disclaimers and Liability Limits
The Services are provided on an 'as is' and 'as available' basis to the maximum extent allowed by law.
AI output may be inaccurate or incomplete and should be reviewed by qualified professionals before reliance.
To the maximum extent allowed by law, RealtorDock is not liable for indirect or consequential damages.
11. Termination
You may stop using the Services at any time. We may suspend or terminate access for violations, non-payment, or security concerns.
Sections that by nature should survive termination will survive, including payment obligations and liability limits.
12. Real Estate Industry Compliance
The Services are tools to assist licensed real estate professionals. RealtorDock does not provide legal, tax, or financial advice.
AI-generated content (including CMA reports, listing descriptions, market analyses, and communications) must be reviewed by a licensed professional before use in any transaction.
You are solely responsible for complying with your state's real estate commission rules, MLS policies, fair housing laws, and brokerage policies when using the Services.
Document signing features are provided through third-party e-signature providers. You are responsible for ensuring e-signatures comply with your state's requirements (ESIGN Act, UETA, and state-specific rules).
RealtorDock is not a party to any real estate transaction facilitated through the Services.
13. Communications Compliance
When using AI-generated communications (email, SMS, voice), you must comply with CAN-SPAM, TCPA, and applicable state telemarketing laws.
You are responsible for maintaining proper consent records for all contacts receiving automated communications through the Services.
The AI Voice Receptionist feature records and transcribes calls. You must comply with your state's call recording laws (one-party vs. two-party consent) and provide appropriate disclosures.
14. Governing Law
These Terms are governed by Delaware law, excluding conflict-of-law rules. Venue is in courts located in Delaware unless otherwise required by law.
15. Changes and Contact
We may update these Terms from time to time. Continued use after an update means you accept the revised Terms.
